If you are thinking of buying somewhere, you may want to get a Valuation carried out. If you’re having one done by a Mortgage lender, it is for the lenders benefit, not yours. It is also mainly aimed at informing the lender whether their exposure to risk is satisfactory or not. The larger the deposit you are putting down, the more relaxed they will be anyway. These reports are often also very basic, sometimes done with automatic valuation modelling (AVM) meaning that a computer has worked out the value, possibly without a Chartered Surveyor even stepping into the property. 

Our Market Valuations are far more detailed and of course, we will inspect the property, assuming it is possible to do so. They can also accompany a Home Survey report providing a thorough health check of the property and opinion of it’s Market Value.

As Chartered Surveyors, most of our reports also need to follow the RICS Red Book, that being the gold standard for Valuation reporting and best practice. All of our qualified Surveyors have attained the designation of RICS Registered Valuer which means they have proven competence and experience in providing Red Book valuations.

The Courts often require input from a Chartered Surveyor, most frequently on an opinion on Valuation but sometimes also on Survey issues such as boundary disputes, defective or unnecessary work. The Courts will often require that the Chartered Surveyor is also an RICS Registered Valuer which is an additional level of expertise that a Surveyor must demonstrate in order to attain. 

We can be appointed by an individual party looking at proving their point but in doing so, they should be aware that Expert Witness work such as Court compliant valuations requires complete independence. That means, we have to put forward what we believe is entirely correct. We cannot take a ‘position’. It’s perhaps because of this that in most cases, we are appointed on the basis of being a Single Joint Expert. This means appointment either directly by both of the parties or sometimes by a solicitor (e.g. a Family Law solicitor or a Litigation Lawyer) with agreement of both parties. 

Frequently our appointment only begins at the point where litigation has started or looks inevitable. However, on occasion, we may have already been involved if for example, the report is on a lease extension or enfranchisement matter where consideration is made into applying to the First Tier Tribunal of the Lands Chamber.

Getting good quality Valuation advice from a Chartered Surveyor can be just as important as taking good advice from a Probate solicitor, Chartered Accountant, Tax advisor or another professional working in taxation. Your advisor may save you a few thousand pounds by ensuring for example that an allowance is taken account of. 

Market Valuation reports have to be provided on an Independent basis. As such, they can’t be designed to save money but can ensure that the correct amount is paid. It is far more likely that HMRC would challenge a valuation that results in tax lower than they believe is correct being payable than more than they believe. 

Our Market Valuation reports for Inheritance Tax, Capital Gains tax, SDLT assessments and for Annual Tax on Enveloped Dwellings are detailed and robust. They are extremely rarely challenged by HMRC and if they are, we are prepared to defend them rigorously.
