Statutory tax valuations
If you are selling a property held as investment where a Capital Gain is made, legislation introduced in 200 provides that Capital Gains tax needs to be paid within 30 days if the disposal is after 6th April 2020.
To determine the amount of tax payable, you may need a Market Valuation report. The Royal Institution of Chartered Surveyors provide Industry best practice for such reports within a document known as the RICS Red Book. This also references Section 272 of the Taxation of Chargeable Gains Act 1992.
Getting a report right not only ensures that the right amount of tax then becomes payable. It also ensures that it is far less likely to be challenged by HMRC, mitigating the risk of costly and time consuming challenges including penalty provision.
If you trying to secure Probate following the death of a property owner, you may also require an Inheritance tax valuation report. This again, is regulated by the RICS Red Book and can help determine the amount of tax payable as well as being a requirement for gaining probate in some circumstances.
